General Information About Personal Data Law
Law No. 6698 on the Protection of Personal Data (hereinafter referred to as “KVKK”) was adopted on March 24, 2016, and published in the Official Gazette No. 29677 on April 7, 2016. Some provisions of KVKK came into force on the publication date, and the remaining provisions came into force on October 7, 2016.
Information as Data Controller
As the Data Controller under Law No. 6698, your personal data will be recorded, stored, updated, disclosed/transferred to third parties where permitted by law, classified, and processed in the manner described on this page in accordance with the purposes stated under KVKK.
How Your Personal Data May Be Processed
Under KVKK, the personal data you share with our Company may be obtained partially or fully, automatically or non-automatically (as part of any data recording system), and may be recorded, stored, modified, reorganized, or otherwise processed in any manner. Any operation performed on the data under KVKK is considered “processing of personal data.”
Purposes and Legal Grounds for Processing Your Personal Data
The personal data you share is processed to:
• Fulfill the requirements of services provided to our customers, in accordance with contracts and technological needs, and to improve the products and services we offer;
• Record identity, address, and other necessary information of the data subject in accordance with Law No. 6563 on the Regulation of Electronic Commerce, Law No. 6502 on Consumer Protection, the Regulation on Service Providers and Intermediary Service Providers in Electronic Commerce (Official Gazette: 26.08.2015/29457), the Distance Sales Contracts Regulation (Official Gazette: 27.11.2014/29188), and other relevant legislation;
• Comply with obligations in banking and electronic payment systems, electronic or paper-based records, and reporting requirements required by legislation and other authorities;
• Provide information to prosecutors, courts, and relevant public officials upon request, regarding public safety or legal disputes;
Your personal data will be processed in accordance with KVKK and related secondary legislation. Third parties or organizations to which your data may be transferred include: Gobax.com.tr (our e-commerce infrastructure provider), suppliers, cargo/shipping companies, program partners acting as data processors, domestic and international organizations, and other third parties necessary for our activities and services.
How Your Personal Data Is Collected
Your personal data may be collected as follows:
• Through forms on our website and mobile applications, including name, surname, Turkish ID number, address, phone, business or personal email, username and password login preferences, IP records of transactions, browser cookies, navigation time and details, and location data;
• Verbally, in writing, or electronically through our sales and marketing staff, branches, suppliers, other sales channels, paper forms, business cards, digital marketing, call centers, for purposes such as establishing commercial relations, job applications, proposals, and other related processes;
• Indirectly from other channels, including websites, blogs, competitions, surveys, games, campaigns, micro-websites, social media, newsletter reading/clicking behavior, publicly available databases, and publicly shared profiles and data from social media platforms.
Personal Data Obtained Before KVKK Came into Force
Personal data legally obtained before April 7, 2016, such as membership data, electronic communication consent, product/service purchases, and other lawful means, are also processed and stored in accordance with the terms and conditions in this document.
Transfer of Personal Data Abroad
Your personal data, whether processed in Turkey or abroad, may be transferred to service providers located abroad (in countries accredited by the Personal Data Protection Board and providing adequate protection), in accordance with KVKK and contract purposes.
Storage and Protection of Personal Data
Your personal data will be kept confidential in our databases and systems in accordance with Article 12 of KVKK and will not be shared with third parties except for legal obligations or as stated in this document. Our company is responsible for preventing unlawful processing of personal data, preventing unauthorized access, implementing software measures such as access management, and taking physical security precautions. Any unauthorized access or unlawful acquisition of personal data will be immediately reported in writing to the Personal Data Protection Board in accordance with legal regulations.
Keeping Personal Data Accurate and Up-to-Date
According to Article 4 of KVKK, our company is responsible for keeping your personal data accurate and up-to-date. To fulfill its legal obligations, our customers must provide accurate and updated data or update it via our website/mobile application.
Rights of Personal Data Owners Under KVKK
According to Article 11 of KVKK, effective from October 7, 2016, personal data owners have the following rights when applying to our company (data controller):
• To learn whether their personal data has been processed,
• To request information if their personal data has been processed,
• To learn the purpose of processing and whether data is used in accordance with that purpose,
• To know the third parties in Turkey or abroad to whom the personal data has been transferred,
• To request correction if personal data is incomplete or incorrect,
• To request deletion or destruction of personal data in accordance with Article 7 of KVKK,
• To request that corrections, deletions, or destruction be notified to third parties to whom data has been transferred,
• To object to decisions arising from automatic analysis of processed data that negatively affect them,
• To request compensation for damages caused by unlawful processing of personal data.
Milsis Av, registered with Istanbul Chamber of Commerce, MERSIS No: {company_mersis}, located at Şerifali Mah. Büyükyavuz Sokak No: 28-30/28 Ümraniye/İstanbul, is the Data Controller under KVKK. The appointed Data Controller Representative will be announced in the Data Controllers Registry and on this website once the legal infrastructure is established.
